Devalley Terms of Service
Effective: November 16, 2026
These terms govern the Devalley desktop app, the devalley.app website, the Pro subscription and everything that comes with them. By installing, creating an account or using the Service you agree to them. If you do not agree, do not use the Service.
Chapter 1. General
Article 1 (Purpose)
These terms set out the rights, duties and responsibilities between the operator of Devalley (the "Operator") and members in connection with the Devalley service (the "Service").
Article 2 (Definitions)
- "Service" means, together: (a) the Devalley desktop app for Windows and macOS and its command-line tool (the "App"); (b) the website at https://devalley.app and its paths, including accounts, the community and the studio (the "Site"); (c) the paid "Pro" plan and its benefits; and (d) related features the Operator adds.
- "Operator" means the person who designs, builds and runs the Service. The Operator is an individual developer who has not yet registered a business; the contact address is support@devalley.app.
- "Member" means a person who has agreed to these terms and created an account. "User" means anyone who uses the Service, members included.
- "Account" means a member's standing in the Service, identified through GitHub or Google sign-in.
- "Pro" means the paid monthly plan; its benefits are those in Article 14 and on the Site's pricing page.
- "Content" means posts, comments, images, packs, looks, profile information and everything else uploaded to or created inside the Service. "Member Content" is what members upload; "Operator Content" is what the Operator provides.
- "Pack" means a bundle of art and settings for the village's map, residents and buildings; "Official Pack" means a pack the Operator makes and provides as a Pro benefit or sells; "Community Pack" means a pack a member made and uploaded to the Site; "Look" means a combination of appearance parts for the chief or a resident.
- "Agent" means a coding agent or terminal program a member runs on their own computer (Claude Code, Codex, Gemini CLI and the like). Agents are separate software made by their own providers and are unrelated to the Operator.
- "Payment Processor" means Paddle.com Market Limited and its affiliates ("Paddle"), which handle money payments for Pro and Official Packs as merchant of record.
Article 3 (The Operator's standing and succession)
- The Service is provided by the Operator as an individual. If the Operator registers a business or forms a company and transfers the Service to it, that business or company succeeds to all of the Operator's rights and duties under these terms, and the Operator will announce this on the Site and by site notification.
- The Operator may transfer or merge all or part of the Service to a third party. Notice is given under Article 29, and members' rights continue against the transferee.
Article 4 (Posting and amending the terms)
- The Operator posts these terms at /legal/terms on the Site where members can read them easily.
- The Operator may amend these terms within the limits of applicable law, including the Act on the Regulation of Terms and Conditions, the Act on Consumer Protection in Electronic Commerce and the Act on Promotion of Information and Communications Network Utilization and Information Protection.
- Amendments are posted on the Site at least 7 days before they take effect, with the effective date and the reason, and announced to members by site notification and in the App. Changes that are unfavourable to members or otherwise material are posted and announced 30 days ahead.
- A member who does not object before the effective date is deemed to have accepted the amendment; the notice under paragraph 3 says so. A member who does not accept may delete their account, and any remaining paid period is handled under the Refund Policy.
- Continuing to use the Service after the effective date also counts as acceptance.
Article 5 (Other rules)
- The following documents form part of these terms. Where they conflict, the specific document governs its subject: (a) the Privacy Policy (/legal/privacy); (b) the Refund Policy (/legal/refund); (c) the Community Rules (/legal/community); (d) the pack and licence guidance and pricing information the Operator posts on the Site.
- Matters not covered here follow applicable law, including the Act on Consumer Protection in Electronic Commerce, the Act on the Regulation of Terms and Conditions, the Act on Promotion of Information and Communications Network Utilization and Information Protection, the Personal Information Protection Act, the Content Industry Promotion Act and the Copyright Act of the Republic of Korea, and ordinary commercial practice.
Chapter 2. Accounts
Article 6 (Creating an account)
- You must be at least 14 years old. Sign-ups under 14 are not accepted, and the Operator deletes any account found to belong to a person under 14.
- Accounts are created by signing in with a GitHub or Google account. During sign-up you agree to these terms and the Privacy Policy, choose a handle and must keep an accurate email address on file.
- The Operator may refuse a sign-up or later terminate an account when: (a) it was made with someone else's or false information; (b) a previously restricted person signs up again; (c) the sign-up is made to collect free trials or promotions repeatedly; (d) an intent to break the law or these terms is evident; or (e) technical or operational reasons make it impractical.
- The App's free features need no account. An account is required only for Pro, buying packs, taking part in the community (posts, comments, reports and the like), device linking and other account-based features. The community home, the boards' post lists, notice posts and the docs can be read without one.
Article 7 (Managing and securing your account)
- An account is for the member alone and may not be lent, sold or transferred.
- You are responsible for securing your sign-in methods, such as your GitHub or Google account. The Service has no password of its own, so a compromised sign-in method compromises the account. If you lose every GitHub and Google account you sign in with, the account cannot be recovered, so linking a second sign-in in Settings is recommended; a Pro subscription can still be cancelled from the link in your Paddle receipt email.
- Approving a device code in the App links that device to your account. Approve only codes requested from devices you control.
- If you learn that your account has been taken over or otherwise compromised, sign out of all sessions from Settings and tell the Operator at once.
- The Operator is not liable for loss arising from a breach of paragraphs 1 to 4 unless the Operator acted with intent or gross negligence.
Article 8 (Handles, display names and profiles)
- A handle is the unique name that identifies a member within the Service and consists of lowercase letters, digits and underscores.
- The following handles, display names and profile images are not allowed: (a) those impersonating another person, an organisation or the Operator; (b) those using another's trademark, name or likeness without permission; (c) profanity, hate, obscenity or discrimination; (d) those that could be mistaken for Service functions or staff (such as admin, devalley or support); (e) anything else contrary to law or public morals.
- Whether your profile is public is up to you in Settings. A public profile is visible to other signed-in members.
Article 9 (Dormant accounts, leaving and termination)
- You may delete your account at any time from the Data page in Settings. Sign-in and Pro benefits stop immediately, your account details are deleted or made unidentifiable at once, and the remaining records are removed within 30 days. A deleted account cannot be restored, and the same email can sign up again only 24 hours after leaving. The email of an account the Operator closed for a breach of these terms cannot sign up for three years.
- Deleting your account during a Pro subscription counts as cancelling it at once; refunds for the remaining period follow the Refund Policy.
- Posts and comments you made public remain as those of a "deleted user", and public packs and looks may remain in other members' downloads and in backups. The packs you made are taken off the lists at once and can no longer be bought or received, but the pack versions other members hold stay on the server so those members can download them again (Article 16-3(5)). The Operator may keep the minimum records needed for dispute handling, abuse prevention and legal obligations.
- An account with no sign-in for a year may be treated as dormant. The Operator may delete it after notice posted on the Site and sent as a site notification 30 days ahead. Accounts with an active paid subscription are not deleted.
- The Operator may terminate an account under Article 22 for breach of these terms or on the grounds in Article 6(3).
- Deleting your account removes its coins, XP, clothes, decorations, bought packs (Official Packs bought with money included) and received community packs; none is restored, moved to another account or refunded. Ask for any refund you are owed under the Refund Policy before you leave.
Chapter 3. The Service
Article 10 (What the Service is and how it may change)
- The Service consists of: (a) the App, a free desktop program that shows the agent sessions running on your computer as residents of a pixel village, with their status, notifications and inbox, and lets you send text to a session and answer it from the conversation window (on the free plan, the App and the Site may show sponsor notices placed by the Operator); (b) the Site, with accounts, boards, pack and look galleries and pack sales (Article 16-3), the studio and the column; (c) Pro, the paid benefits of Article 14.
- The Service is early-stage software. The Operator may add, change or remove features, offer features experimentally or roll them out to some members first.
- The Operator may discontinue all or part of the Service. For a full shutdown the Operator posts notice on the Site 30 days ahead and sends a site notification; from that day no new payment is taken and every subscription is set to end at its next billing date. The paid period remaining after the shutdown date is refunded under the Refund Policy, and packs bought with money or coins can be downloaded as unsealed files before the end. Where an event outside the Operator's control (natural disaster, change of law, shutdown of the payment processor or hosting provider) forces an immediate stop, notice may follow afterwards.
- The Operator may suspend the Service temporarily for maintenance, incident recovery or security response. Planned maintenance is announced in advance; urgent work may not be.
- The Service is available in Korea and elsewhere, but the Operator does not guarantee availability in any particular country and may restrict regions where the law requires.
Article 11 (Licence to the App)
- Subject to these terms, the Operator grants users a free, non-exclusive, non-transferable, revocable licence to install and run the App for personal and work use.
- The App is closed-source software. Users may not: (a) modify, translate or make derivative works of it, or reverse engineer, decompile or disassemble it (except as the Copyright Act or other law expressly permits); (b) copy, redistribute, sell, rent or lease it or embed it in another service; (c) circumvent or remove plan checks, Official Pack protection or any other restriction; (d) remove or alter trademark or copyright notices.
- The App may contact devalley.app to check for and download new versions (the Operator's server sees your IP address at that moment). Whether to install an update is up to you (the Windows installer downloads a new version ahead and installs it only when you choose it in the tray menu). The Operator may end support for old versions.
- The App includes open-source components distributed under their own licences. Their notices are in the App's licence screen and the repository, and nothing here limits the rights those licences grant.
Article 12 (Notice about observing agents and terminals and typing into them)
- The App reads the state (working, waiting on a question, done) and the text (the terminal screen, the end of the session's log, finished answers) of the terminals and agent sessions running on your computer and shows it in the village. That information stays on your computer and is not sent to the Operator. For the conversation window, the App keeps finished answers and the requests they answer on your computer.
- Text, choices and keys you send or press in the conversation window are typed by the App into that session's terminal as your own input, and when you press it, the App starts a closed session again without a terminal window. The App never types input you did not send or press. What an agent does on input typed this way is likewise governed by paragraph 3.
- The commands an agent runs, the files it changes, the network requests it makes and their results are entirely between you and the agent's provider. The Operator plays no part in an agent's behaviour and is not liable for anything an agent does or fails to do.
- The village's indicators (question marks, done marks, speech bubbles) are a convenience and may be late, missing or wrong. You may answer an agent's permission requests in the village. A card may show only part of a request, and checking what you allow is your responsibility; check important commands in full in the terminal before answering. The App is not a security control. Other accounts on the same computer can see the village's state on that computer.
- You must use agents and terminal programs under their providers' terms. The way the App hooks into an agent (hooks, reading status files, tmux) may stop working when a provider changes something; the Operator does not guarantee compatibility with any particular agent.
Article 13 (Third-party integrations)
- You may connect Slack, GitHub and other external services to the App yourself. The tokens and credentials used stay on your computer and never reach the Operator.
- Use of those services is governed by their own terms, to which the Operator is not a party. The Operator is not liable when an integration stops working because of changes, outages or discontinuation on their side.
- The Operator may change or drop an integration in view of policy changes, security or maintenance cost.
Article 14 (Pro)
- Pro is a paid plan that renews monthly. Its benefits are those listed on the Site's pricing page (for example official premium packs, resident packs, 48 of your own residents and the App without ads). Changes to the benefits listed there follow the amendment procedure of Article 4 (posted and announced 7 days before they take effect, 30 days for changes unfavourable to members or materially reducing a core benefit), and members who disagree may cancel before the next renewal. When the Operator retires an Official Pack, it posts notice on the Site 30 days ahead and sends a site notification to the members who turned the pack on or bought it. After that nobody can turn it on or buy it anew; members who bought it with money or coins keep it and can download it again, while members who used it as a Pro benefit lose it on the day it is retired. Where there is an infringement or another legal reason, the pack is retired at once without notice and the reason is given.
- The reference price is KRW 1,900 a month in Korea and USD 2 a month elsewhere; the amount actually charged is the one shown at checkout, taxes included. Price increases are announced 30 days ahead and apply from the next renewal after that; you may cancel before renewal to avoid them.
- Payments are handled by Paddle as merchant of record. Paddle takes the payment method, calculates and remits taxes and issues receipts, and Paddle's buyer terms also apply to the transaction. Paddle emails receipts and invoices with each payment, and they can be downloaded again from "Manage subscription" on My page; as Paddle is the seller, no Korean tax invoices (세금계산서) or cash receipts (현금영수증) are issued. The Operator never receives card numbers or other payment-method details.
- A subscription starts when payment succeeds and renews on the same day each month (or the last day of a shorter month). If a renewal payment fails, Pro continues for 3 days after the billing period ends, and changing the payment method within them keeps it going. If no payment goes through by then, Pro benefits stop, and changing the payment method while the subscription is still past due turns them back on.
- You may cancel at any time with the "Cancel subscription" button on My page or the link on your Paddle receipt. Cancellation takes effect at the next renewal date, and Pro remains active for the period already paid. Refunds for mid-period cancellation follow the Refund Policy.
- When Pro ends, Pro-only features such as Official Packs lock, but your village data and community content remain. Official Packs used as a Pro benefit are licensed only while you subscribe; continuing to use them afterwards is prohibited under Article 21. Packs bought with money or coins keep working after Pro ends (Article 16-3(3)). Packs you published stay as well, but no new pack or version can be uploaded (Article 17-2(1)).
Article 15 (Free trial and promotions)
- New accounts get Pro free for 30 days, once per email address for all time. To enforce this the Operator keeps a hash of the email address even after the account is deleted.
- The trial does not convert into a paid subscription automatically. To keep Pro you must subscribe yourself.
- The Operator may grant Pro free through promo codes, limited-time offers or administrator grants on conditions set at the time. Benefits obtained in breach of those conditions or by fraud may be revoked without notice.
- Collecting trials or promotions repeatedly through multiple accounts or other people's email addresses is prohibited, and all accounts involved may be restricted.
- Pro granted free of charge is never refundable or redeemable for cash.
Article 16 (Withdrawal and refunds)
- Refund conditions and procedure are set out in the Refund Policy (/legal/refund). Members ask for a refund on the Site's support board under the category "Refund"; people without an account or unable to sign in, and those asking by their Paddle receipt, write to support@devalley.app or use the link in the Paddle receipt email.
- Pro is digital content and a service whose provision begins immediately on payment. Under Article 17(2)5 and 17(6) of the Act on Consumer Protection in Electronic Commerce, the Operator states before payment that the right of withdrawal is limited and provides the 30-day free trial as the opportunity to try the content. Accordingly, once you have downloaded Pro-only content or used Pro-only features after paying, the right of withdrawal is limited.
- Despite paragraph 2, you receive a full refund if you have not used any Pro-only content or feature within 7 days of payment. Other refund rules are in the Refund Policy.
- A pack bought with money is digital content that reaches the account the moment you pay, so it is not refunded, and at checkout the Operator asks you to agree that downloading or opening the pack ends the right of withdrawal. As the law requires, it is refunded nonetheless (a) within 7 days of payment if there is no record of the pack being downloaded or opened, or (b) if the pack does not work as described or is defective (Article 17(3) of the Act on Consumer Protection in Electronic Commerce). Coins are not bought with money and are never refunded, and purchases made with coins are final.
- Nothing in this article limits rights that mandatory consumer law gives you.
Article 16-2 (Coins and what you buy)
- Coins are points used only inside the Service, which a signed-in member earns by village activity in the App (with a daily cap) or receives when a pack they made is bought. Coins buy clothes, decorations and packs and nothing else.
- A signed-in member's coin balance and history and what they own (clothes, decorations, bought packs, received community packs) are kept with the account, and the server's records are what counts. The coins and purchases of an App not signed in stay on that computer. At the first sign-in, if the account's wallet is empty, that computer's coins (up to 3,000; the rest stay on that computer) and purchases move to the account once; if the account already has some, the account's are used.
- The Operator does not sell coins for money, and coins have no cash value. Coins cannot be exchanged for money or anything else, sent to another account or refunded, and a purchase made with coins is never cancelled or reversed, except that coins another member pays for a pack you made go to your account (Article 16-3(2)).
- Coins obtained by error or by unfair means (such as tampering with App data), and what they bought, may be taken back or adjusted by the Operator, with the reason recorded.
- Selling or buying coins, packs or accounts for money or anything else outside the Service is prohibited (Article 21(10)).
Article 16-3 (Pack sales and the packs you hold)
- Official Packs are sold for money and for coins. A money payment is a one-time payment Paddle handles as merchant of record (as in Article 14(3)); the Operator sets the money price and the coin price and shows them on the pack's page and at checkout. Community Packs are sold for coins only, at a price the Pro member who made the pack sets between 0 and 500 coins (0 coins is free). No member can buy a pack they made.
- Coins paid for a Community Pack go at once to the wallet of the member who made it, and the buyer's and the maker's coin histories show the same purchase number.
- Official resident packs are part of the Pro benefits, so Pro members use them without buying them. Pro members pay the coin price of Community Packs like anyone else. A bought pack stays with the account and keeps working after Pro ends.
- A member without Pro may hold up to 3 free Community Packs at a time. Bought packs and Official Packs do not count, and the count is kept by the account's record, not by the computer. To take a fourth, let one of the free Community Packs you hold go first. Pro members have no limit.
- When a Community Pack is taken down, whether after a report or review or because its maker deleted it or left, the members who already hold it (those who bought it and those who received it free) keep it and can download it again on any computer. To make that possible the Operator keeps on the server the file of every pack version someone holds. A pack taken down only leaves new buying, receiving, the lists and search, and the coins paid are not given back.
- The only exceptions to paragraph 5 are where the law requires removal or a stop. For illegal information such as illegally filmed material or child sexual exploitation material, the Operator deletes the pack file and stops downloads. A pack whose reproduction and transmission is stopped at a rights holder's request under Article 103 of the Copyright Act cannot be downloaded from the server, by its holders either, while it is stopped (the App does not delete files already on a computer), and can be downloaded again once it resumes (Article 20(3)). In neither case are coins given back.
- When the payment for a pack bought with money is refunded or charged back, the pack leaves the account.
- Retiring an Official Pack follows Article 14(1).
Chapter 4. Content
Article 17 (Member Content)
- You (or the original rights holder) keep the copyright and other rights in the content you upload.
- You grant the Operator a worldwide, royalty-free, non-exclusive licence to store, copy, convert (thumbnails, previews, resizing), display, distribute and transmit your Member Content in order to provide, run, improve and promote the Service. The licence extends to the providers the Operator uses to run the Service (hosting, storage and the like) within the same scope.
- For content you made public, the licence in paragraph 2 continues after you delete it or leave, and after the pack is taken down, but only as to (a) copies other members already downloaded or installed, (b) the copy of each pack version kept on the server so that members who received or bought the pack can download it again (Article 16-3(5)), (c) backups, caches and search indexes, and (d) promotional material (screenshots, videos) the Operator made before the deletion. Content whose reproduction and transmission was stopped for copyright infringement, however, cannot be downloaded from the server again, even by members who already received it. On request the Operator stops using that content in new promotional material.
- When you publish a pack you choose its licence from CC0 1.0, CC BY 4.0 and all rights reserved; if you choose none, it is all rights reserved. Official Packs are always all rights reserved. The licence applies as is to the members who download the pack, and an all-rights-reserved pack may be used by other members in their own App only, without redistribution or modification. After the first publication a licence can only become more open (all rights reserved → CC BY 4.0 → CC0 1.0), and the record of what a member received keeps the licence at that time. Copies already distributed under an open licence (CC0, CC BY) may continue to be used under it. A pack with a coin price of 1 coin or more can be published only as all rights reserved, so a pack already published under a CC licence cannot be given a price (publish it as a new pack to charge for it).
- You warrant that (a) you have the right to upload the content and grant the licence in paragraph 2, (b) the content infringes no one's copyright, trademark, likeness, personal data or other rights, and (c) it does not copy characters, games or works of others. You bear all liability for breaching this warranty. The Operator asks you to confirm this warranty every time you upload a pack version, and records when you confirmed it and the wording you confirmed with that version.
- Apart from reviewing a Community Pack's first publication (Article 17-2(4)), the Operator has no duty to review Member Content in advance and does not warrant its accuracy, legality or quality, reviewed content included. Disputes arising from Member Content are for the member who uploaded it to resolve.
Article 17-2 (Making packs and review)
- Only Pro members can make and upload packs, and there is no limit on how many. Packs a member without Pro made before, and packs a member published before their Pro ended, stay as they are, but no new pack or version can be uploaded.
- Up to 10 versions can be uploaded a day, and the files' format and size follow the limits in the Community Rules and the pack-making doc (/docs/packs).
- Version numbers only go up. The member who made a pack (the Operator, for Official Packs) may withdraw a published version: it can no longer be downloaded anew, and the version published before it becomes the latest. Members who already hold the withdrawn version keep it, and its number cannot be used again.
- The first publication of a Community Pack is reviewed by the Operator against the pack review criteria in the Community Rules, aiming to finish within 3 business days of receipt. A rejection names the criterion broken and the reason. New versions of an approved pack and changes to its name, description or cover go out at once; the Operator checks them afterwards (aiming at 3 business days) and, if needed, withdraws the version or hides the pack.
- The member who made a pack may unpublish or delete it. A deleted pack disappears from the lists and from its page, and an unpublished pack can no longer be bought or received. Either way, members who already hold the pack keep it under Article 16-3(5).
Article 18 (Operator Content and intellectual property)
- The Devalley name and logo, the pixel art of the village, residents and buildings, the maps, the Official Packs, the design, code and documentation of the App and Site, and everything else the Operator made are the Operator's copyright and intellectual property. These terms transfer none of it to members.
- Official Packs are provided for the personal use, in their own App, of a Pro member while subscribed or of a member who bought the pack. Extracting, redistributing, selling or adapting an Official Pack or any part of it (sprites, tiles, settings) or using it in another service is prohibited. When the subscription ends the App locks the Official Packs used as a Pro benefit (bought packs excepted), and members must not circumvent that.
- You are free to post screenshots and recordings of the App on blogs, social media, reviews and talks; the Operator welcomes it. Do not distribute Official Pack source files alongside them or present the material as endorsed by the Operator.
- Third-party names and logos used in the Service (Claude Code, Codex, Gemini CLI, GitHub, Slack and others) are trademarks of their owners, with whom the Operator has no affiliation or sponsorship.
Article 19 (Feedback)
Suggestions, ideas, bug reports and requests you send to the Operator ("Feedback") may be used, implemented and disclosed by the Operator freely, without compensation or obligation. You will not claim confidentiality or payment for Feedback.
Article 20 (Content moderation and infringement notices)
- Where Member Content breaches, or there is reasonable cause to believe it breaches, the law, these terms or the Community Rules (/legal/community), the Operator may hide, remove or make it private without prior notice. Content hidden for breaking the Community Rules stays hidden, with no time limit, until the Operator restores it. After acting, the Operator tells the member by site notification what was done, why, and how to object.
- Anyone who believes their rights are infringed may request removal, or a stop to reproduction and transmission, through the content's report button (for copyright, with the reason "Copyright") or at support@devalley.app, showing proof of their right and where the infringement is. For requests about defamation, privacy, personal data and the like, the Operator may remove the content under Article 44-2 of the Act on Promotion of Information and Communications Network Utilization and Information Protection or, where the infringement is hard to judge or a dispute is expected, block access temporarily for up to 30 days. This temporary measure lasts only as long as the law sets and is separate from the hiding for rule breaches in paragraph 1.
- On a request to stop reproduction and transmission under Article 103 of the Copyright Act, the Operator at once stops the content's publication and downloads and tells both the member who uploaded it and the requester. If the member shows a legitimate right and asks for it to resume, the Operator tells the requester the resumption date (a day between 7 and 14 days after receiving the resumption request) and puts the content back on that day, unless the requester tells the Operator before then that they have brought a lawsuit.
- The account of a member whose content has been taken down for copyright infringement three times is terminated. Action on reports for reasons other than copyright (spam, harassment and the like) is decided by the Operator under the Community Rules.
- A member subject to a measure may ask for reinstatement at support@devalley.app within 15 days of the notice, stating their case (a request to resume under paragraph 3 follows paragraph 3). The Operator decides after hearing both sides but has no duty to adjudicate rights disputes between them.
Article 21 (Prohibited conduct)
Users must not do any of the following. The rules of each board, the posting limits and the standards for action are in the Community Rules (/legal/community), which form part of these terms.
- Break the law, use the Service for crime or evade lawful requests from investigators or courts.
- Infringe others' copyright, trademark, patent, likeness, reputation, privacy, personal data or other rights, including uploading characters or assets from other games or works as they are or lightly altered.
- Impersonate the Operator, another member or a third party, or suggest an affiliation that does not exist.
- Post or engage in obscenity, child sexual abuse material, gratuitous violence, hate or discrimination, encouragement of self-harm or suicide, harassment, threats or stalking.
- Advertise, promote, spam, solicit for pyramid schemes or investments, or post repetitively or otherwise commercially against the community's purpose (unless the Operator permits it).
- Upload or spread malware, viruses or any code or file that harms others' computers or services, including executable code or hidden data inside pack files.
- Circumvent, disable or manipulate the Service's technical restrictions, such as payment, plan checks, Official Pack protection, rate limits or the record of coins earned.
- Crawl, scrape, automate or bulk-request the Service or other members' information, or load the Service, without the Operator's express permission; this includes calling the API the App uses from other programs.
- Exploit vulnerabilities, access others' accounts or data without authorisation or disrupt the Service's normal operation. Please report vulnerabilities to support@devalley.app.
- Sell, buy, transfer or share accounts, Pro benefits, promo codes, coins or packs outside the Service, for money or anything else (buying and selling packs inside the Service under Article 16-3 excepted).
- Collect trials or promotions repeatedly through multiple accounts or other people's email, or abuse the refund process.
- Abuse the report feature with false or repeated reports, or create new accounts to evade the Operator's measures.
- Collect or publish other members' personal information (email, real name, location and the like).
- Redistribute or sell Official Packs or other members' all-rights-reserved content.
- Do anything else the Community Rules (/legal/community) prohibit or that offends public morals.
Article 22 (Restrictions)
- For a breach of Article 21 or any other provision, the Operator may, according to its gravity, hide or remove content (Article 20) and apply one of these sanctions: (a) a write ban: for a set period you cannot post or edit posts, comments, looks or packs on the Site or change your profile, while reading, the App and the support board work as before; (b) a suspension for a period: you cannot sign in for a set period; (c) a permanent suspension: you cannot sign in again, your community packs are taken off the lists, new downloads and sale (members who already own one keep it), your public looks are hidden and your profile is made private. Posts and comments are hidden or removed one by one as reports are handled.
- The Operator may suspend permanently or terminate the account at once and without prior notice for: (a) breaches of law; (b) grave breaches such as child sexual abuse material or malware; (c) circumventing payment or plan checks; (d) disrupting the Service's operation; (e) repeated breaches.
- A suspension, for a period or permanent, cancels the member's Pro subscription at once, and the time left is not refunded (Refund Policy, section 7(4)). A write ban leaves the subscription as it is. A suspended member is shown the reason, the end date and how to object when signing in; a write ban is announced by site notification. Where immediate action is needed, notice may follow.
- A sanctioned member may object at support@devalley.app within 15 days of the notice, and a member under a write ban only may also object on the support board. The Operator informs the member of the outcome within 7 days of receiving the objection.
- Pro fees for a period of restriction caused by the member's breach are not refunded. If an objection succeeds and the restriction proves to have been wrong, the Pro period is extended by the restricted time or refunded.
- The Operator may cooperate with lawful requests from investigators and courts as the law requires.
Chapter 5. Liability
Article 23 (Service level and disclaimer of warranties)
- The Service is provided "as is" and "as available". The Operator does not warrant that it will be uninterrupted or error-free, fit for a particular purpose, or compatible with any particular agent, operating system or terminal.
- As an early-stage service run by an individual, the Operator promises no service level agreement and no support response time.
- Backing up the village data the App stores on your computer (journal, to-dos, inbox, settings) is your responsibility. The Operator cannot recover local data lost through uninstalling, disk failure or reinstalling the operating system.
- The Operator neither warrants nor is responsible for Member Content, other members' conduct, or the behaviour, outages or policy changes of third-party services (agent providers, GitHub, Slack, Paddle, hosting providers and others).
- This article does not exclude liability for the Operator's intent or gross negligence and does not limit rights mandatory consumer law gives you.
Article 24 (Limitation of liability)
- To the fullest extent the law allows, the Operator is not liable for indirect, special, consequential or punitive damages, lost profits, loss of data, loss of business or the cost of substitute services arising from use of or inability to use the Service.
- To the fullest extent the law allows, the Operator's total liability in connection with the Service never exceeds the amount you paid to the Operator (or through Paddle) in the 12 months before the event giving rise to the claim. Toward users of the free Service, the Operator is liable only where the law imposes liability.
- The Operator is not liable for loss arising from: (a) commands, file changes and network requests an agent carried out and their results (including those carried out on text or choices you sent from the conversation window); (b) decisions made in reliance on late, missing or wrong village indicators; (c) content you uploaded or downloaded, packs included; (d) your failure to secure your sign-in methods; (e) outages of third-party services and networks; (f) disputes between members; (g) your breach of these terms.
- Paragraphs 1 to 3 do not apply to loss caused by the Operator's intent or gross negligence, nor to liability that cannot be limited under Article 7 of the Act on the Regulation of Terms and Conditions or other law.
Article 25 (Indemnity)
If your breach of these terms or the law causes the Operator loss, or leads a third party to bring a claim, suit or administrative proceeding against the Operator, you will compensate the Operator for its loss (reasonable legal fees included) and hold it harmless. The Operator will notify you and cooperate in the defence.
Article 26 (Force majeure)
The Operator is not liable for failing to provide the Service because of natural disaster, war, terrorism, epidemic, power or network failure, outage or shutdown of third-party services such as hosting, payment or identity providers, law or government action, or any other cause beyond its reasonable control.
Article 27 (Third-party services and trademarks)
- The Service works with third-party services such as agent providers, GitHub, Google, Slack, Paddle and Cloudflare. Their use is governed by their own terms, and the Operator is not responsible for their content or operation.
- Devalley is independent software with no affiliation, sponsorship or endorsement from Anthropic, OpenAI, Google, GitHub, Slack or any other agent or service provider. Their names are their owners' trademarks and are used only to describe compatibility.
Chapter 6. Miscellaneous
Article 28 (Notices)
- The Operator notifies members by Site notifications, notices in the App or posting on the Site, singly or together. Email to the registered address is used only where these cannot reach you or the law requires it. Notice to all members or to an unspecified number of them may be given by posting on the Site for at least 7 days.
- You must keep your registered email address able to receive mail. Unless the Operator acted with intent or gross negligence, you bear any disadvantage from missing an email notice under paragraph 1 because the address was wrong or blocked.
- Notices from you to the Operator go to support@devalley.app.
Article 29 (Assignment)
- You may not assign your standing, rights or duties under these terms to anyone, nor pledge them, without the Operator's prior written consent.
- The Operator may assign its rights and duties under these terms when transferring the business to a third party or to a business or company it forms under Article 3. The Operator announces the transfer, the transferee and the date 30 days ahead (succession under Article 3 may be announced afterwards), and members who disagree may delete their account before that date.
Article 30 (Effect of the terms)
- If any part of these terms is found unlawful or invalid, the rest remains in force, and the invalid part is deemed replaced by the valid provision closest to its intent.
- The Operator's failure to enforce a right promptly is not a waiver of it.
- These terms and the documents in Article 5(1) are the entire agreement between the Operator and the member about the Service and replace any earlier oral or written agreement.
- These terms are written in Korean; the English text is a translation for convenience. Where they differ, the Korean text prevails.
Article 31 (Governing law and disputes)
- Disputes about these terms and the Service are governed by the laws of the Republic of Korea.
- The Operator and the member first try in good faith to settle a dispute through support@devalley.app. Members who are consumers may apply for mediation to the Korea Consumer Agency, the Content Dispute Resolution Committee or the Electronic Commerce Mediation Committee.
- Suits not settled by negotiation are brought before the court having jurisdiction under the Civil Procedure Act of Korea. For members without a domicile or residence in Korea, the Seoul Central District Court is the court of first instance, so far as mandatory law allows.
- Nothing in this article limits rights that mandatory law of a consumer's country of residence outside Korea gives them.
Addendum
- These terms take effect on November 16, 2026 and replace the terms in force from October 9, 2026.
- They also apply to members who signed up before that date.
- What changed: leaving takes effect at once and a deleted account cannot be restored (Article 9), and the examples of Pro benefits now name what Pro actually gives (Article 14). New rules cover pack sales and the packs you hold (Article 16-3), making packs and review (Article 17-2), refunds of packs (Article 16(4)), pack licences (Article 17(4)) and retiring an Official Pack (Article 14(1)); the Community Rules (/legal/community) form part of these terms (Article 5); the Operator no longer changes or reclaims handles (Article 8); and hiding for rule breaches, the temporary measure for infringements and the copyright procedure are set out separately (Article 20). The App's description and the notice about agents now cover sending text to and answering a session from the conversation window and starting a closed session again (Articles 10 and 12(1)–(2)); the notice says you may answer permission requests in the village, that checking what you allow is your responsibility, and that other accounts on the same computer can see the village's state (Article 12(4)); and what the conversation window carried out counts as what an agent carried out (Article 24(3)).
